Erica is a staff attorney dedicated to supporting the firm’s labor and employment practice group. Erica defends clients from claims asserted in administrative actions, state and federal court litigation, and appellate courts. Erica’s litigation experience includes executive compensation and other contract-based claims; wage-and-hour work including classification of workers as contractors; whistleblower and retaliation claims; enforcement of arbitration agreements; and defense of employment discrimination, wrongful termination, and employee leave claims. 
Erica has a special interest in customizing the means and methods used for discovery of electronically stored information (ESI) to avoid costs and delays disproportionate to the amount in controversy in the litigation. Time and again, Erica has developed ESI solutions that are effective and reasonable in cost and scope. Customization of the ESI approach requires a close working knowledge of the legal issues involved in the claims and defenses of each case. Erica prefers and enjoys a holistic and investigative approach to litigation matters such that development of the ESI strategy for a particular matter is closely married to development of the overall litigation strategy.

Erica’s interest in ESI dovetails her interest in related tech areas such as data privacy, wiretap laws, blockchain technology, and cryptocurrency. Erica is a frequent speaker on various legal issues related to digital currency, and maintains a focus on matters such as taxation of cryptocurrency; verification of digital transactions; and privacy challenges.

In addition to her litigation-based practice, Erica spends a significant amount of time helping clients comply with local, state, and federal laws and regulations. Erica regularly drafts and implements workplace policies, procedures, contracts, and notices. Erica also supports clients during the due diligence phase of corporate transactions. Erica has significant experience assisting her corporate lawyer colleagues with investigation and characterization of employment and wage/hour risks based on materials and information provided during due diligence.
